While businesses are usually started with good intentions, sometimes changes can happen where the business assets could be at risk of damage or loss.

If your company needs to be protected while an issue is resolved, then a Court Appointed Liquidator (Provisional Liquidation) can be the next best option. It doesn’t liquidate the company, it only places it under the care of an outside party until the situation is resolved, saving it from further damage.

What is Provisional Liquidation?

Provisional Liquidation allows for an independent third party to take control of the company while an issue is being sorted out; or to protect the assets while an Administrator is being appointed.

There’s 3 main reasons for applying for a Provisional Liquidation:

Your debtor company is hiding assets

If you’re a creditor who believes that your debtor company is hiding assets / making them unavailable; or they’re being put at risk of loss while you’re waiting for a wind-up application to be heard.

Directors acting in a reckless manner

If you’re a shareholder of a company where you believe that the directors are acting in an unprofessional, reckless or self-benefitting manner.

A dispute between directors

If a dispute happens between directors of the company; or the company is insolvent and needs protection before an official liquidator is appointed.

Our company is a Medical recruitment agency with mostly Government based clients. We had a good sales forecast……but were heavily weighed down with debt, mostly from the ATO.
